These Terms of Service govern your use of HomeCurve. By submitting a valuation request or otherwise using the service, you agree to these terms. If you don't agree, please don't use HomeCurve.
— 01Overview
HomeCurve ("we," "us," "our") provides a free home valuation service that connects homeowners with vetted local real estate professionals. We are not a real estate brokerage, and we do not buy, sell, list, or appraise property ourselves. We are a referral and information service.
By using HomeCurve, you ("you," "your," "user") enter a binding agreement with HomeCurve based on these terms and our Privacy Policy.
— 02The service
When you submit a valuation request, you provide information about your home and how to contact you. We:
- Match your request with a single licensed real estate professional in your area
- Forward your request to that professional, who prepares a comparative market analysis (CMA) using available public records, recent sales data, and their local market knowledge
- Facilitate delivery of the report to you by email, and where you've consented, by phone or SMS
The CMA is prepared and delivered by the local real estate professional, not by HomeCurve directly. HomeCurve provides the platform; the professional provides the analysis.
— 03Valuations are estimates, not appraisals
Our valuations are based on information you provide, publicly available data, and the professional judgment of the local real estate professional preparing your report. They are subject to the limitations of any market estimate and may differ — sometimes substantially — from a formal appraisal, an actual sale price, or a tax assessment.
If you need a formal appraisal — for example, for a mortgage, divorce, estate, tax appeal, or insurance claim — you should engage a state-licensed real property appraiser.
— 04Agent referrals
HomeCurve connects you with one independent licensed real estate professional in your area. That professional is not employed by, partnered with, or controlled by HomeCurve. They operate their own business and are independently licensed by their state's real estate commission.
What HomeCurve does
- Verifies that participating professionals hold a current real estate license in good standing
- Routes your valuation request to a single professional in your zip code
What HomeCurve does not do
- Supervise, control, or direct the work of the professional
- Guarantee the accuracy, completeness, or timeliness of any valuation, advice, or service the professional provides
- Become a party to any agreement, listing contract, or transaction you enter into with the professional
- Take responsibility for any dispute that may arise between you and the professional
Any agreement to list, sell, or buy property — and any other professional service — is solely between you and the real estate professional. You are under no obligation to engage the professional for any further service.
— 05Your information & conduct
You agree that:
- The information you submit is accurate, complete, and your own (or you have authority to provide it)
- You will not submit false addresses, fake names, fictitious phone numbers, or property information you don't own or have authorization to inquire about
- You are at least 18 years old, or have the legal capacity to enter into binding agreements in your jurisdiction
- You will not use HomeCurve to harass, defraud, or impersonate others, or for any unlawful purpose
We reserve the right to refuse service, suspend access, or delete submissions that violate these terms or appear fraudulent.
— 06Communications & consent
By submitting your valuation request, you consent to receive communications from HomeCurve and the local real estate professional matched to your area, related to your request and our service.
You will receive transactional emails (such as your valuation report and confirmation messages) related to your request. You may opt out of non-essential marketing emails at any time using the unsubscribe link in any email.
Phone & SMS
If you provide a phone number and check the consent box on the form, you authorize HomeCurve and the local real estate professional matched to your area to contact you by phone, text message (SMS), or both, including by automated dialing systems and pre-recorded messages, regarding your valuation and related matters.
- Consent is not a condition of receiving your valuation — you can complete the form without providing a phone number
- Standard message and data rates may apply
- Message frequency varies based on your interaction
- Reply STOP to opt out of SMS at any time; reply HELP for help
For full details on how we handle phone and SMS data, see Section 5 of our Privacy Policy.
— 07Intellectual property
HomeCurve, the HomeCurve logo, the HomeCurve mark, all related design elements, the website, and any reports, content, or materials we produce are the intellectual property of HomeCurve and are protected by copyright, trademark, and other applicable laws. You may not copy, reproduce, distribute, or create derivative works from any of it without our prior written permission.
The CMA report you receive is for your personal, non-commercial use. You may share it with your spouse, lender, or attorney, but you may not republish, distribute, or use it commercially without permission.
— 08Disclaimer of warranties
Some jurisdictions do not allow the exclusion of certain warranties, so the above exclusions may not apply to you in full. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
— 09Limitation of liability
This limitation applies regardless of the legal theory (contract, tort, statute, or otherwise) and even if we have been advised of the possibility of such damages.
— 10Indemnification
You agree to indemnify, defend, and hold harmless HomeCurve and its owners, affiliates, and employees from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of:
- Your use or misuse of the service
- Information you submit that is inaccurate, false, or unauthorized
- Your breach of these terms
- Your violation of any law or third-party right
— 11Termination
We may suspend or terminate your access to HomeCurve at any time, with or without notice, for any reason, including violation of these terms. You may stop using HomeCurve at any time. Sections that by their nature should survive termination — including disclaimers, limitations of liability, indemnification, and dispute resolution — will survive.
— 12Disputes & governing law
Governing law
These terms are governed by the laws of the State of Maryland, without regard to its conflict of law provisions. Any dispute will be resolved in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts.
Informal resolution
Before filing any formal claim, you agree to first contact us at legal@homecurve.com and attempt to resolve the dispute informally. We'll do the same. Most disputes can be resolved this way.
Class action waiver
To the fullest extent permitted by law, you and HomeCurve agree that any dispute will be resolved on an individual basis, and not as part of a class action, consolidated action, or representative proceeding.
— 13Changes to these terms
We may update these terms from time to time. When we do, we'll update the "Last updated" date at the top. Material changes will be communicated to active users by email. Continued use of HomeCurve after changes take effect means you accept the updated terms.
— 14General provisions
Entire agreement
These terms, together with our Privacy Policy, are the entire agreement between you and HomeCurve regarding the service and supersede any prior agreements.
Severability
If any provision of these terms is found unenforceable, the remaining provisions will remain in full force and effect.
No waiver
Our failure to enforce any right or provision of these terms is not a waiver of that right or provision.
Assignment
You may not assign or transfer these terms without our written consent. We may assign these terms without restriction.
Force majeure
We are not liable for any delay or failure in performance caused by circumstances beyond our reasonable control, including acts of nature, war, terrorism, civil unrest, government action, labor disputes, internet or telecommunications failures, or pandemics.
